Apr. 30, 2020

CRANBERRY – Joined by more than 40 of his House and Senate Republican colleagues, Representative Daryl Metcalfe (R-Butler) has signed on to the letter below urging United States Attorney General William Barr and the Department of Justice to investigate the COVID-19 policies implemented by the Wolf administration.

He also issued the following statement:

“I fully concur with United States Attorney General Barr that our Constitutional rights and God-given individual liberties should never be violated, even in times of crisis.

“Wolf’s unconstitutional dictates and Orwellian overreach into our lives and the marketplace has caused immeasurable harm and hardship for far more Pennsylvanians than the virus and clearly warrant an official Department of Justice investigation.

“At minimum, the Wolf administration needs to be investigated for manipulating COVID-19 case data to falsely justify shutting down our economy; capriciously and arbitrarily closing down thousands of job-creating employers; and depriving more than 1 million Pennsylvania citizens of the right to earn their daily bread.”

Re: Defending Constitutional Rights of Pennsylvanians

Dear Attorney General Barr:

We write to applaud your memorandum of April 27, 2020, in which you directed the Department
of Justice to monitor state and local policies, and to urge the Department to review the policies
implemented by the administration of Governor Tom Wolf in Pennsylvania during the COVID19 emergency.

This unprecedented public health emergency has tested our Commonwealth’s resilience in many
ways. But just as the emergency has tested the resilience of our citizens, so too has it tempted
the authority of our Executive.

Overbroad limitations on commerce have unduly paralyzed regions of Pennsylvania, the Second Amendment rights of citizens have been impacted, and many fear that their rights to worship will remain constrained. Certainly, we recognize the reasonableness of temporary restrictions to preserve public safety, but we also are vigilant in defending against the encroachment on inviolate constitutional rights.

As you explained in your memorandum, “the Constitution is not suspended in times of crisis.” The freedoms enshrined in that hallowed document are perhaps most importantly honored during times of crisis. We ask your attention to ensuring the constitutional rights of Pennsylvanians to work, speak, defend themselves, and worship remain inviolate.
